2. Filing a DMCA Notice of Copyright Infringement

  1. Identification of the Protected Work: A clear description of the copyrighted work that you claim has been infringed, or, if multiple works are covered by a single notice, a representative list of such works (including copyright registration numbers or original portfolio URLs, if available).

  2. Identification of Infringing Content: The specific uniform resource locator (URL) or product page link(s) on https://quynhtrangleshop.com/ where the allegedly infringing material is located, detailed enough for us to locate and remove the item.

  3. Complainant Contact Details: Your full legal name, physical mailing address, telephone number, and active email address.

  4. Good-Faith Statement: A statement that:

    “I have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law (such as fair use).”

  5. Accuracy & Perjury Statement: A statement made under penalty of perjury that:

    “The information in this notification is accurate, and under penalty of perjury, I am the owner, or authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.”

  6. Authorized Signature: A physical or electronic signature (e.g., typing your full legal name) of the copyright owner or a person authorized to act on their behalf.

3. DMCA Takedown Procedure (Safe Harbor Actions)

Upon receiving a legally sufficient DMCA notice meeting all statutory requirements outlined above:

  1. Expeditious Removal: We will review the notice and expeditiously remove or disable access to the challenged product listing or artwork.

  2. Production Halt: Any pending print orders involving the reported artwork will be held or canceled.

  3. Notification to Uploader/Supplier: We will make a good-faith attempt to forward a copy of the takedown notice to the content provider, designer, or supplier associated with the listing, advising them of the removal.

4. Counter-Notification Procedure

If content you created or authorized has been removed as a result of a mistake or misidentification, you may submit a formal Counter-Notification pursuant to 17 U.S.C. §§ 512(g)(2) and (3). A valid counter-notification must be in writing and include:

  1. Your physical or electronic signature.

  2. Identification of the specific material that was removed or to which access was disabled, and the specific URL/location where it appeared prior to removal.

  3. A statement under penalty of perjury:

    “I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.”

  4. Your legal name, physical address, and telephone number.

  5. A statement consenting to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the District of Montana if you reside outside the United States), and that you will accept service of process from the person who provided the original DMCA notification or their agent.

Upon receipt of a valid counter-notification, we will forward a copy to the original complaining party. Unless the copyright owner files a court action seeking a restraining order within 10 to 14 business days, we may restore the removed material at our discretion.

5. False Claims Warning (17 U.S.C. § 512(f))

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that it was removed by mistake or misidentification, may be subject to liability for statutory and monetary damages (including court costs and attorney’s fees) incurred by the alleged infringer, copyright owner, or service provider.

6. Repeat Infringer Policy

In accordance with Section 512(i)(1)(A) of the DMCA, Quynh Trang Le Shop maintains a strict policy to terminate accounts, vendor agreements, or contributor privileges of any user, designer, or fulfillment partner identified as a repeat infringer.
